Owner of Material Object or Caretake of Pet? Analysis of the Pets’ Status under the Polish Animal Protection Act
Abstract
The article presents an analysis of the legal status of pets under the Polish Animal Protection Act. The introduction presents the main assumptions of the animal protection system and the diverse nature of regulations concerning disparate groups of animals. The principal purpose of the considerations was to draw attention to the inadequacy of the conceptual grid describing human relations with pets within the legal system. The arguments presented were aimed at demonstrating that although the legislator recognizes that animals are not things, in many cases they are functionally treated as things. Thus, the status of pets created by the legislator significantly differs from their public perception. The conclusion presents de lege ferenda proposals for changes in the language used to regulate the situation of pets.
