Editorial Policies

Focus and Scope

The scope of the journal covers studies in the field of legal sciences. The journal's profile also includes scientific publications in interdisciplinary areas such as political science and international relations, if the research results presented therein relate to legal sciences or if the research is carried out from the perspective of legal sciences. The group of authors entitled to propose and publish their texts in the Ars Iuridica include students, doctoral students and academic staff of both Polish and foreign higher education institutions.

Apart from scientific papers, the Ars Iuridica publishes commentaries on rulings of national and European courts. The Editorial Board also accepts for publication reports on developments taking place in the lawyers' community in Poland and abroad.

The mission of the journal is to disseminate nationally and internationally, on an open access basis, the results of research conducted by legal scholars and professionals, taking into account the importance of the impact of legal sciences on the socio-economic environment.

Peer Review Process

  1. Each article is reviewed by at least two independent reviewers from outside the institute.
  2. For articles written in a language other than Polish, at least one reviewer is affiliated with a foreign academic centre but of different nationality than the Author.
  3. A model is preferred in which the Author(s) or authors are not aware of each other’s identity (double-blind review process).
  4. In other instances, the reviewer is obliged to sign a declaration saying there is no conflict  of interest. The following situations are regarded as a conflict of interest: a) direct personal relations (family or legal relationship, conflict), b) work relationships, especially for subordinates c) direct scholarly cooperation in the two years preceding the review.
  5. The review must take a written form and end with an unambiguous conclusion on whether or not the article should be published.
  6. Names of reviewers of given publications or issues are not published. The journal publishes a list of reviewers for all issues once a year.
  7. Editor-in-chief assigns the reviewers after consulting the editorial office staff. The editor- in-chief consults members of academic board as needed.
  8. Author of the article is bound to respond to the notes and comments of the review.

 

Publication Frequency

  • No 1 - scheduled date of issue: before the end of June
  • No 2 - scheduled date of issue: before the end of December

The Editorial Board may decide to release an additional special issue beyond the publishing schedule.

 

Open Access Policy

This journal provides immediate open access to its content on the principle that making research freely available to the public supports a greater global exchange of knowledge.

Publication Ethics and Publication Malpractice Statement

The rules of publication ethics applicable in Ars Iuridica are in line with the guidelines set by the Committee on Publication Ethics (COPE). The editorial board of Ars Iuridica recommends that authors and peer reviewers read the ethical rules presented below and the materials posted on the website of the Committee on Publication Ethics (COPE) (https://publicationethics.org).

§ 1 Author responsibilities

1. Maintaining scholarly integrity

The author shall conduct, present and interpret scientific research in a reliable manner. Any and all data sources and information used in the text submitted should be duly disclosed.

2. Data sharing

The Editorial Board does not collect research data and the presentation of a research data management plan is not required for the publication of a paper. In certain circumstances, however, the authors may be requested to present research data, also after the article publication.

3.  Prohibition of infringement of intellectual property of other authors

    1)  The text must not infringe the copyright of other authors. Plagiarism, duplicate publication, the use of false data and research methods are unacceptable. When using another work, the author must properly identify the author and the source of reference, so that the fragment cited or content referred to does not give rise to any doubt as to the authorship of part or entirety of the work.

    2)  Information obtained privately may not be used in the article, unless with a written permission of its author.

4. Proper identification of authors and other contributors

    1)  The authorship of the article submitted should be limited only to those who have made a significant contribution to the development of the text.  These persons should be identified as co-authors of the text and, furthermore, they should approve the final version of the work and consent to its publication.

   2) Ghostwriting and guest authorship are forbidden.

   3) All persons who have contributed to the creation of the work, including through their substantive involvement in the research, should be listed in a separate section of the article.

   4) The authors shall also indicate the source of funding for the publication, the contribution of research institutions, associations and other entities (“financial disclosure”), if these have provided the support described above.

5. Reporting errors in published articles

If the author notices significant errors in his/her publication, he/she should immediately notify the editor-in-chief. In consultation with the editor-in-chief and the publisher, an erratum, an addendum, or a corrigendum should be published or the publication should be withdrawn.

6. Conflict of interest prevention

The author of the text is obliged to submit a declaration that there is no conflict of interest and provide information that may prevent it, a conflict of interest being understood as a relationship of professional subordination or economic dependence and social relations that may affect an impartial assessment of the value of the text.

7. Necessity of submitting the required consent of the ethics committee to conduct research

Where the article submitted for publication is related to research on humans or animals, the author shall be required to submit the consent of the ethics committee or other authorization for the research.

8. Prohibition of re-publishing the same text

Upon submitting the text for publication, the author declares that the text had not been previously published anywhere, both in paper and electronic versions, it is not a part of another monograph and has not been submitted to editorial boards of other journals.

§ 2 Responsibilities of Editorial Board members

1. Responsibility of the Editorial Board

    1) The editorial board shall decide on the publication of articles and shall take care of the quality of the materials being published.

    2) If necessary, the Editorial Board shall be responsible for publishing an erratum, correction or alteration.

    3)  The Editorial Board is accountable for all the content published in the journal.

2. Keeping confidentiality in relation to the texts submitted

The Editorial Board is obliged to keep information related to the editorial process confidential.

3. Non-discrimination

The text submitted shall be assessed by the editors based on their significance for the journal and their scientific value. The Editorial Board must comply with the rule of non-discrimination against authors on the grounds of origin, nationality, ethnic affiliation, political opinion, gender, race or religion.

4. Verifying texts that have already been published

The Editorial Board is entitled to withdraw the article from publication and to correct the texts already published. The use of unpublished articles in the publishing process requires the written consent of the author.

5. Deciding on publications

The final decision on the publication of the text is made by the editorial team.

6. Discussion and corrections as part of the publishing process

The editorial team uses the Open Journal System to ensure a comprehensive, electronic publishing process in which the editor, reviewer, and author can discuss and make alterations at every stage of the publishing process.

7. Scientific integrity compliance supervision

    1) Editorial Board members are obliged to care about the scientific integrity of the texts published.  If there is a suspicion of ethical malpractice in the form of plagiarism, falsification of research results, tampering of research results, etc., it should be reported in writing to the editor-in-chief or secretary for further investigation.

    2) Those entitled to report include a member of the Editorial Board, a reviewer, a reader, and any other person who has a suspicion about author's dishonesty in creating a text.

    3) If an ethical infringement is confirmed in an article already published, the editors are obliged to withdraw the text from the journal's website, stating the reasons for the withdrawal. Moreover, Editorial Board members are obliged to inform the author of the text, the affiliating institution, the reviewers, those whose rights have been infringed and, if necessary, the ethical supervision bodies. 

    4) If the degree of abuse by the author is identified as minor, the text will be allowed to be republished after correction.

    5) The proceeding of the Editorial Board of Ars Iuridica is in line with the publication ethics rules as provided for by the Committee on Publication Ethics (COPE) https://publicationethics.org.

8. Complaints and appeals

A complaint against the Journal or the Editorial Board should be submitted in writing to the editor-in-chief.  If the complaint concerns the editor-in-chief, it should be sent to the Publisher along with a carbon copy to the editor-in-chief. The complaint may concern, among other things: excessive time of processing, negligence, infringement of the complainant's interests or Editorial Board's inactivity. The complaint should be settled within 30 days from the date of filing.

§ 3 Reviewer responsibilities

1. Keeping confidentiality in relation to the texts submitted

The text under review are only available for authorised persons, i.e. the Editorial Board, the author and Ars Iuridica's reviewers.

2. Compliance with review deadlines

Reviewers must comply with the review deadlines.  If there are reasons that prevent a reviewer from completing the review or cause abandoning the review, the reviewer should inform the editor immediately.

3. Keeping the objectivity of review

A review of the text should only include remarks on substantive or formal issues. Any comments relating to the person of the author are not permitted.

4. Verification of the reliability of the sources referred to

If there is a probability of the author infringing the copyright of another person, the reviewer must identify the parts of the work that are similar to another work and the publications that are not mentioned in the reviewed text.

5. Cooperation with the Editorial Board

Reviewers contribute to the final form of the text and the editors' decisions regarding the publication of the article.

6. Conflict of interest prevention

Reviewers are not allowed to use the articles for their own purposes and for achieving personal or material gain. If there is a conflict of interest with the author of the text, the reviewers should be excluded from the review process.

§ 4 Publisher's statement

1. In the event of alleged or proven case of scholarly unreliability, fraudulent publication or plagiarism, the Publisher, acting in close cooperation with the Editorial Board, shall take all appropriate measures to clarify the situation and make modifications to the article. This includes the prompt publication of an erratum or, in the most serious cases, the complete withdrawal of the work concerned.

2.  The Marie Curie-Skłodowska University Publishing House applies the rules of publication ethics according to the guidelines of  the Committee on Publication Ethics (COPE) and supports Ars Iuridica in this matter, in particular by consultancy and professional legal assistance; provision of access to the plagiarism checker software; access to and technical assistance for Open Journal Systems (OJS), which should allow the Editorial Board to manage the publishing process in accordance with the highest quality and ethical standards.
